V. Damit ist auch in den Niederlanden best\u00e4tigt, dass Kindermann mit ihrer Collaboration-L\u00f6sung Klick&amp;Show das geltend gemachte Patent des belgischen Unternehmens nicht verletzt hat.<\/strong><\/p>\n\n\n\n<p>Bereits im Jahr 2021 hat das niederl\u00e4ndische Gericht erster Instanz den Vorwurf der Patentverletzung zur\u00fcckgewiesen, und zwar auch bei unterstellter Rechtsbest\u00e4ndigkeit des Patentes. Barco ging damals in die Berufung. Das Berufungsgericht in Den Haag hat nun am 18.07.2023 die erstinstanzliche Entscheidung und zudem den Widerruf des Patents von Barco in den Niederlanden best\u00e4tigt, nachdem Barco die Berufung zur\u00fcckgezogen hatte.&nbsp;<\/p>\n\n\n\n<div style=\"height:36px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-primary-color has-text-color\"><strong>\u201e<\/strong>Wir sind sehr froh, dass der Patentstreit in den Niederlanden nun abgeschlossen ist. Das signalisiert auch f\u00fcr unsere Handelspartner Rechtssicherheit. In der Zwischenzeit haben wir Klick&amp;Show kontinuierlich weiterentwickelt. Das Ergebnis sind universelle BYOM- &amp; BYOD-L\u00f6sungen, die die Anforderungen der neuen Arbeits- und Bildungswelten ideal erf\u00fcllen<strong>\u201c<\/strong><\/p>\n<cite>so Timo Mei\u00dfner, Gesch\u00e4ftsf\u00fchrer der Kindermann GmbH.<\/cite><\/blockquote>\n\n\n\n<div style=\"height:40px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Derzeit l\u00e4uft noch ein Verfahren zur G\u00fcltigkeit des Patents von Barco beim Europ\u00e4ischen Patentamt. Hier ist Kindermann nicht allein, auch weitere Anbieter von \u00e4hnlichen Collaboration-L\u00f6sungen zweifeln die G\u00fcltigkeit des Patents an, einer Ansicht, der sich auch die Einspruchsabteilung des EPA angeschlossen und das Patent widerrufen hat.
